As noted in court documents, Mark represented a tractor-trailer driver who was harmed in the course of making an after-hours delivery at a warehouse. Records show the man had stepped into a pothole in the warehouse parking lot while descending from his tractor-trailer.

In addition to the presence of the pothole, which should have been recognized as a potential danger by the premises owner, lighting in the facility was insufficient. The lack of lighting, it was argued, made it difficult to see deficits and potential hazards on the parking lot.

As a result of stepping into the pothole, the man suffered injury to a ligament in his ankle, which caused considerable pain, reduced mobility, and the need to undergo surgery.

By illustrating failures of the facility owner in rectifying hazards it knew or should have known about – including both the pothole and insufficient lighting in the parking lot – Mark was able to successfully negotiate an out-of-court settlement for his client totaling $300,0000. The recovery will aid Mark’s client in covering his medical expenses, pain and suffering, and other economic and non-economic damages.
