Do I Need A Lawyer For A Car Accident

As a general guideline, it’s best to contact a lawyer after a car accident as soon as possible. The first reason to do so is the statute of limitations. The statute of limitations is a law which is implemented on a state by state basis which limits how long claimants have to file any personal injury claim. According to the New Jersey Statutes section 2A:14-2 the state of New Jersey has a two-year timeline. This means you have two years from the date your accident occurred to file your claim or you will most likely be unable to do so. There are some exceptions to this law where the filing time may change, including:

  • If the injury victim is a minor at the time the accident occurred
  • The negligent party left the state before a claim could be filed

Beyond the statute of limitations, which applies to all personal injury claims, car accident injuries are different than other injuries covered by personal injury law in that they are most usually soft tissue injuries. Soft tissue injuries are injuries that affect the tendons, ligaments and muscles. An example of a soft tissue injury would be whiplash. Like whiplash, these types of injuries typically progressively get worse over a few days or weeks after the injury occurred.

Because of this, many injury victims sign a compensation agreement with an insurance company before talking to a lawyer only to later discover that their injuries are worse than they initially thought but are not able to recover any additional compensation to cover their costs. If you have suffered injuries at the hands of a negligent driver, talk to our New Jersey car accident attorney for help today!

You may also recover compensation for non-economic damages such as your pain and suffering and loss of quality of life.

Filing NJ PLIGA Benefits Claims

If you have been in an auto accident, you have the option to file a claim with the New Jersey Proper-Liability Insurance Guaranty Association (NJ PLIGA). You will need to file a Proof of Claim (POC) with the Liquidator to begin the claims process. They will then forward this claim to NJ PLIGA for review.

Although you may be concerned with filing a claim as soon as possible, it's worth discussing your case with a New Jersey auto accident attorney first. You may have other options for recovering more compensation.
