Result: Michael Fusco Recovers $100K for Victim Who Fell on Defective Staircase

In March, Levinson Axelrod, P.A. Partner Michael Fusco recovered a $100,000 settlement for a client who suffered injuries in a trip and fall accident.

As stated in court documents, Michael’s client had been attending a funeral when she tripped and fell on a defective staircase. She suffered vertebral compression fractures in her lower back.

Following an investigation of the premises, Michael was able to determine that the staircase did not have a center handrail as required by building code regulations. It was alleged in the lawsuit that the handrail was likely removed to make room for caskets, creating a safety hazard. A safety expert retained by Fusco cited this hazardous condition, combined with a lack of ushers at the funeral parlor, as the cause of the fall.

Having prepared considerable evidence against the premises owner, Michael was able to negotiate a pretrial settlement in which the defendant agreed to pay $100,000.
