New Jersey Medical Malpractice Attorney Adam Rothenberg Recovers $600,000 at Trial for Client Injured During Surgery

The verdict stems from a medical malpractice lawsuit in which Adam and our firm claimed our client had suffered a preventable nerve injury to his spinal accessory nerve (SAN) during a surgical procedure on his neck. The surgery was performed to remove a fatty lipoma, a slow-growing and typically harmless lump of fatty tissue which can develop between the skin and underlying muscle tissue.

While our lawsuit alleged the nerve injury could and should have been prevented if not for medical negligence, the defense denied any fault or liability, and argued the injury occurred as a result of ordinary retraction rather than any failure to meet accepted medical standards.

Because the defense was unwilling to accept responsibility for our client’s injury and damages, Adam and our team worked diligently to conduct the necessary investigations and legal work to prove our claims and secure needed justice for our client. This includes our expert general surgeon testifying at trial that the defendant had deviated from accepted standards of care when they failed to protect our client’s spinal accessory nerve during surgery. Our expert neurologist also testified that our client’s injury was permanent.

Following a two-and-a-half week trial, during which Adam presented extensive evidence to support his arguments against the defense, the jury returned a verdict siding with our client. Their decision to award $600,000 in compensation means the defense will in fact be held accountable for failing to uphold its duty of care, and that our client will receive the needed financial resources to cover his injuries and losses and meet his future medical needs, including continued decreased use of his right arm and shoulder, a disability that affects many facets of his life.
