Levinson Axelrod, P.A. Attorney Kathleen DiGiovanni Secured $2.5 Million Jury Verdict for Auto Accident Victim

Levinson Axelrod is pleased to announce that Associate Attorney Kathleen M. DiGiovanni was recently successful in securing a $2.5 million jury verdict on behalf of a client who was seriously injured in an auto accident on the New Jersey Turnpike.

The case, which was tried before the Honorable Owen McCarthy, J.S.C. in Monmouth County Superior Court, stemmed from a collision that took place one evening as our firm’s client was traveling from Manhattan to his home in New Jersey. While on the New Jersey Turnpike, our client was not aware that a vehicle had stopped in traffic, as the driver had all lights turned off and failed to turn on its hazard lights or give warning to oncoming motorists. As a result, our client was unable to avoid a collision that sent his vehicle into another lane of traffic, where it sustained a second impact after being struck by another motorist.

As the result of the two collisions, our client suffered serious injuries, including multiple hip fractures that necessitated emergency surgery. In addition, medical experts in the case stated that our client, who is in his late 40s, will require additional medical treatment and a revision surgery as he gets older.

Fortunately for our client, Kathleen leveraged her extensive trial experience to advocate aggressively in litigation against attorneys representing our client’s insurance provider, and who stood in place of the defendant in an underinsured motorist claim (UIM). Her ability to refute the defense’s argument that our client was negligent in contributing to the wreck proved successful in gaining the support of the jury, who found the defendant driver 100% liable for the crash, and awarded our client $2.5 million in damages.
