A carpenter working as an independent contractor was injured at defendant’s refinery when he was improperly exposed to dangerous fumes. Ronald Grayzel handled this occupational exposure case and ultimately settled the matter for $975,000.00.

Mark Kuminski of our office was able to obtain a $950,000 settlement for a Jamesburg woman, who suffered an aggravation of her preexisting lower back condition when her vehicle was struck from behind by a landscaping vehicle while stopped at a red traffic light. The plaintiff was still actively treating for her prior neck and back conditions when the new accident occurred.

Levinson Axelrod, P.A. Partner Todd Wachtel of our Raritan office secured a $950,000 settlement for the spouse of a worker who passed away from COVID-19. According to court documents, Todd represented the widow and family of a delivery driver who caught COVID-19 in March 2020 and later passed away from his illness. Todd filed a dependency action in the Division of Labor, Department of Worker’s Compensation seeking benefits for the deliver driver’s wife and two minor children. Under the Emergency Orders issued by Governor Murphy, the burden was on the insurance carrier to prove that the COVID exposure came from outside of the workplace, which they eventually conceded that they could not prove. Ultimately, a Judge of Workers’ Compensation in Plainfield approved a settlement in the amount of $950,000.00. This is one of the larger settlements of our Worker’s Compensation Department, and we are extremely grateful to be able to provide some relief for this family.

A Spotswood resident was injured when the vehicle he was driving collided with a fuel tanker truck which was blocking off the plaintiff’s lane of travel while pulling out from a local gas station. The plaintiff suffered an aggravation of his pre-existing heart and kidney conditions, which subsequently caused his overall health to deteriorate. While at the hospital, the plaintiff likewise developed M.R.S.A., a Methicillin resistant Staphylococcus Aureus infection. The case was handled by Mark Kuminski of our office.

A 57-year-old woman was injured when the bench that she was sitting on in a coffee shop collapsed. She suffered an ankle injury, which required two surgeries. Shortly after her fall, she was likewise involved in a subsequent motor vehicle accident, in which aggravated her ankle issues, as well as aggravating a pre-existing injury to her wrist. 

Kim Gozsa of our office successfully represented a client who was injured in a motor vehicle collision with an oncoming vehicle, which occurred when that vehicle was improperly trying to pass a third vehicle that was stopped while waiting to make a left-hand turn. The plaintiff suffered a herniated disc in her neck, for which she was subsequently required to undergo surgery.
