Mark Kuminski of our office represented a man who was injured when he was struck by a forklift while at work, thereby suffering multiple orthopedic injuries. The man was struck by the forklift while he was standing inside a designated safety zone, trapping his leg between the forklift and a nearby metal bollard. The case settled for $2,250,000.

Patrick Flinn of our office represented a 70-year-old man who was injured when he tripped and fell over a pallet that was left behind a dumpster at a local pet supply store. Our client suffered a torn quadriceps tendon, which required two operations. The surgeries were unsuccessful in fully repairing the damage. The case settled for $2,200,000.

A Bergen County woman was struck by a New Jersey Transit bus while attempting to cross the street at an intersection located in Fairview New Jersey, thereby suffering fatal injuries. The defendant driver claimed that he did not see the pedestrian as she had been walking in the street, rather than on the sidewalk, and likewise was likewise attempting to cross the intersection outside of the marked crosswalk. The matter was handled by Mark Kuminski and settled for $3,000,000.

The plaintiff was employed as a mason and working on a construction site located in Princeton New Jersey. While pouring concrete, he stepped backwards into an uncovered hole, thereby falling waist deep into same. He injured his lower back, thereby requiring surgery. In a case handled by Mark Kuminski of our office, the plaintiff claimed that the general contractor for the worksite had failed to provide the plaintiff with a safe place in which to work. The defendant denied any knowledge or responsibility for the condition. The defendant likewise claimed that the plaintiff’s back surgery was related to a pre-existing condition for which he had recently undergone surgery and had last treated for ten days earlier.

A 31-year old iron worker was injured in a construction site accident when he was struck in the head by a cinder block. Despite the facts that he was wearing a hard hat at the time, the plaintiff still received a serious closed head injury resulting in both memory loss and total disability. The case was handled by both Richard Levinson and James Dunn and settled at the time of trial.

Levinson Axelrod, P.A. Partner Brett Greiner recently secured a $2,000,000.00 settlement during the preparation stages of a trial, including jury selection in Middlesex County. Brett represented a Carteret man who was rear-ended by another vehicle, resulting in back and neck pain. After two weeks, the pain did not get better, so he went to his family doctor. Upon medical evaluation, the doctor ordered X-rays and referred him for chiropractic treatment. When his symptoms continued even after the specialized care, his doctors administered injections in his upper and lower spine to reduce inflammation and pain. The injections in the neck were helpful, but the one in his back did not provide any appreciable amount of pain relief or mobility improvements. Using his medical provider’s recommendations, he next underwent surgery to remove two damaged discs in his lower back. The discs were replaced with spacers at two levels, which were then fused together. One of the spacers shifted over the following months, which is a known complication risk for that type of surgery, and a second surgery was needed to correct it. Given all the pain and health complications he had endured, our client realized that exploring his legal options might be the only way to set things right. Initially, the defendants did not want to settle the matter and tried to dispute liability and the links between our client’s serious back and neck injuries and the car accident. Once the jury selection process was completed in Middlesex County, the defendants seemed to recognize that our client’s case had been built by a reputable team, so settlement negotiations began.
