Levinson Axelrod, P.A. Secures Workers' Compensation Benefits for Corrections Officer Who Contracted COVID-19

|

In what may be New Jersey’s first court order awarding workers’ compensation benefits to an essential worker diagnosed with COVID-19, Levinson Axelrod, P.A. Partner Richard Marcolus recently prevailed in helping a New Jersey corrections officer secure benefits after contracting the coronavirus at work.

The order, issued by a judge who commented that this was her first claim for benefits over COVID-19, will provide our client with the temporary and medical benefits they need to cover lost wages and medical treatment.

The result is also an indication that Levinson Axelrod is handling some of the first occupational exposure cases in the state related to COVID-19 – cases made possible through the passing of new laws lobbied for by our own team. This includes a bill recently signed by Gov. Phil Murphy that benefits essential workers by creating a legal presumption that their contraction of the coronavirus is work-related. Partner Marcolus recently testified in support of this measure before a state Senate Committee.

Partner Rich Marcolus and our team have been actively advocating for new laws that expand the rights of front line and essential workers, and clear a path for them to secure needed benefits after contracting the virus.

Thanks to their efforts and our state lawmakers, essential workers can now more easily pursue workers’ compensation benefits over workplace exposure to COVID-19. We are hopeful our latest result sends an important reminder to essential workers throughout the state: you have rights after contracting the coronavirus on the job, and Levinson Axelrod is here to help.
