As case filings show, Brett’s client was a pedestrian who had been struck by a vehicle. She suffered an injury to her knee that required arthroscopic surgery. During litigation, Brett was able to compel the defendant’s insurance company to tender the $300,000 in liability coverage the driver had purchased for his car. This was the maximum recovery available under the limits of the defendant’s auto insurance policy.

The plaintiff injured her ankle when she stepped into a cement cut out in a commercial sidewalk where a tree had been planted. The plaintiff had been walking on the sidewalk on her way to a down town holiday festival. Her attention had been distracted by a negligently placed chestnut grilling stand, thereby diverting her attention away from the cut out. The plaintiff brought claims against both the property owner and the operator of the chestnut stand. As a result of her accident, she sustained a badly sprained ankle and went on to develop Complex Regional Pain Syndrome. The case was tried by Mark Kuminski.

On June 25, 2025, Todd Wachtel, Todd Wachtel, Esq., a partner in our Raritan office settled a case on behalf of a nurse who fell at work from a chair injuring her back. The matter was complicated because she previously had a fusion surgery to her low back, and the new accident caused her to have another surgery to her low back. As the insurance company was unwilling to resolve the matter, the parties started the Trial. Once their attorney heard from the injured worker, they agreed with the Judge of Compensation that the claim was worth 57.5% partial total disability, with a credit for her prior injuries.

On June 25, 2025, Todd Wachtel, Esq., a partner in our Raritan office settled a case on behalf of a widow of an electrician who passed away during the course of his employment due to a catastrophic brain hemorrhage at work. This matter was complicated by the lack of direct witnesses, and the man's personal medical history. The insurance company did not believe that his passing arose from the course of his employment. Todd partnered with a doctor that is an Associate Professor at New York University, and an attending physician at a prestigious New York hospital along with numerous investigators to prepare his case. The insurance company sent four different attorneys to Court to defend this matter. The case was then listed for Trial. Before testimony could begin the insurance company settled the matter for the full amount of the Judge's recommendation.
