Types of Car Accidents

A car accident refers to a collision involving one or more vehicles. These incidents can vary in severity, ranging from minor fender benders to more serious crashes causing significant damage, injuries, or fatalities. Car accidents can happen for various reasons, including human error, environmental factors, or mechanical failures.

Common types of car accidents include:

  • Rear-end Collision: Occurs when one vehicle collides with the back of another, often due to sudden stops or distractions.
  • T-bone (Side-Impact) Collision: Happens when the front of one vehicle strikes the side of another, typically at intersections.
  • Head-On Collision: Involves two vehicles colliding front-to-front, often resulting in severe injuries or fatalities.
  • Single-Vehicle Accident: Occurs when a vehicle crashes without involving another vehicle, such as hitting a stationary object or going off the road.
  • Multi-Vehicle Pileup: Involves three or more vehicles in a chain-reaction collision, commonly seen on highways.
  • Sideswipe Collision: This happens when the sides of two vehicles come into contact, often during lane changes or merging.
  • Hit and Run: Involves a driver leaving the scene of an accident without stopping to provide information or assistance.
  • Rollover Accident: Occurs when a vehicle tips onto its side or roof, often due to high speed, sharp turns, or collisions.

Causes of Car Accidents

Car accidents can be caused by a variety of factors. In many cases, negligence is to blame for the accident. Negligence occurs when a person or party fails to act reasonably and, as a result, causes harm to another person. All drivers have a legal duty to operate their vehicles safely and carefully. When a driver breaches this duty and causes a car accident as a result, the driver can be held liable for the victim's damages.

Some of the most common causes of car accidents include:

  • Speeding
  • Reckless driving
  • Drunk driving
  • Distracted driving
  • Texting while driving
  • Tailgating
  • Failure to yield the right of way
  • Running a red light
  • Running a stop sign
  • Defective auto parts
  • Unsafe road conditions
  • Inclement weather
  • And more

New Jersey Car Accident Laws

New Jersey follows a no-fault insurance system. This means that after a car accident, each party involved typically seeks compensation from their own insurance provider, regardless of who was at fault. However, there are exceptions for serious injuries or if the monetary threshold is met. The injuries must result in death, dismemberment, significant disfigurement or scarring, displaced fractures, loss of a fetus, or permanent injury.

Additionally, New Jersey follows a modified comparative negligence system. If you are found partially at fault for the accident, your compensation may be reduced proportionally to your percentage of fault. If you are deemed more than 50% at fault, you may be barred from recovering damages.

The statute of limitations for personal injury claims is generally two years from the date of the accident, while property damage claims have a six-year statute of limitations.
