When can I make a claim?
There are a variety of situations in which an injury results from the negligence of a governmental agency. Here are a few examples:
- If a person were to become injured after falling on a broken sidewalk, he or she might be able to file a claim against the agency responsible for maintaining that sidewalk. Municipal groups are in charge of the upkeep of various city and State properties. If a person is injured as a result of negligent maintenance, a claim can be filed against the responsible municipal agency.
- If a traffic accident is caused by the negligence of a governmental employee (on the job) and you suffer injures and property damage, then you may file a claim against the governmental agency employer of the person who caused the accident.
- When the government fails to properly regulate something that causes injury or sickness in one person or a group of people, a lawsuit may be filed against the government. In January 2004, a group filed a lawsuit against the Washington State Beef Commission for allowing ill cows to be slaughtered and sold as acceptable beef. The group claims that the commission was negligent in regulating food safety, which therefore caused people to become ill.
- If an automobile accident on a public or federal road or highway is caused by an unsafe condition or improperly maintained roadway, there may also be cause to bring an action against the responsible state or federal agency.
The statute of limitations for lawsuits against the State of New Jersey or any governmental agency is very strict and if you do not file the proper documents within the time restrictions you may forever be barred from monetary recovery. If you have been injured and you feel a governmental agency is at fault, you should seek qualified legal representation from Levinson Axelrod, P.A. immediately.
