Result: Rich Marcolus Secures Settlement for Worker with Staph Infection

Rich Marcolus, a Levinson Axelrod, P.A. Shareholder from our Belford office, recently secured a six-figure workers’ compensation settlement for a client with a work-acquired staph infection.

As case records show, Rich represented a man who claimed that he developed a staph infection after kneeling on a screw in the course of his employment. The infection resulted in the need for a course of intravenous antibiotics.

In litigating the case, Rich encountered difficulties with the workers’ compensation insurance carrier, which contended that our clients’ staph infection did not result from his work-related injury and hired a medical expert who opined that the type of infection developed by our client could not be caused by kneeling on a screw.

In response to these contentions, Rich and our team conducted meticulous medical research, which allowed Rich to effectively challenge the testimony of the insurer company’s medical expert and raise doubts as to the soundness of his medical opinion. This in turn fostered productive negotiations during which Rich was able to secure a settlement totaling $200,000.
