Attorney Adam Rothenberg Provides Trial Tips on the Effect of Health Insurance Availability on Damages in Personal Injury Cases in Middlesex County Bar Association Newsletter

Levinson Axelrod partner Adam Rothenberg was recently published in this month’s Middlesex County Bar Association newsletter in an article titled “Trial Tips: Health Insurance Availability and Its Effect on Future Medical Expenses”.

“As recovery companies become more aggressive in chasing medical expenses and Medicare and Medicaid require set-asides, future medical expenses will become a bigger part of personal injury litigation and our courts will be called on to resolve these claims,” Rothenberg wrote. “The framework for recovery of these expenses is still within the traditional principles of negligence, that the liable party is responsible for all reasonable damages flowing from its negligence.”
