New Jersey Trip & Fall Accident Lawyers
Slip & Fall Accidents vs. Trip & Fall Accidents
At Levinson Axelrod, P.A., we provide legal representation for clients who have been injured in trip and falls. Although similar to a slip and fall, the terminology surrounding a trip and fall is notably different. In a slip and fall, the cause of the accident is some form of wet or slippery substance on the ground; an example would be an individual who slipped and fell because of something spilled in a grocery store. On the other hand, a trip and fall occurs because the plaintiff ran into a fixed object in their path or uneven surface that caused them to stumble; an example of this would be tripping on a broken sidewalk, forgotten items, etc.
How Do You Prove a Trip & Fall Claim?
In either case, it is critical that the injured party finds an experienced New Jersey trip and fall injury attorney. Businesses are legally required to provide a reasonably safe environment for visitors. While they cannot be expected to be perfect, they are held to certain standards. One is that they are required to warn visitors of a dangerous condition or remedy the situation. If they fail to do so, the injured party likely has grounds to pursue a personal injury claim for compensation.
The following can be used to prove that the defendant had notice of the unreasonably dangerous condition:
- They or their employees created the condition;
- They or their employees actually knew about the condition; or
- The condition had existed for so long that they should have reasonably known about it.
