What happens if I am successful in pursuing both a Workers’ Compensation claim and a Third Party claim?

Once you are successful in a Workers’ Compensation claim, the Workers’ Compensation Insurance carrier will assert a lien against the proceeds of your Third Party claim. Therefore, before you may receive the proceeds of the Third Party claim, the Workers’ Compensation carrier is entitled to be repaid for those amounts that it paid out on your behalf in the Workers’ Compensation claim. Should there be no Third Party claim, or if it is unsuccessful, then the aforementioned lien would be waived by the carrier and need not be repaid.
