If I bring a claim as a result of a Construction Site accident, who will typically be named as a defendant?

That depends on how the accident occurred. If you were injured due to the negligence of someone working on the site (other than your employer or a co-employee), then they may be liable for your injuries. Additionally, New Jersey Law imposes upon the General Contractor who runs the site the non-delegable duty to provide all workers with a reasonably safe work place. By failing to do so, the general contractor may be liable for your injuries without actually taking an active role in causing your accident. Under either scenario, however, you would still be entitled to Workers’ Compensation benefits.
