I just had an accident. If I selected the “Limitation on Lawsuit” option, do I have a case?

Under the new Act, individuals subject to the “Limitation on Lawsuit” option must have sustained one or more of the following injuries in order to maintain a claim for damages: (1) Death; (2) Dismemberment; (3) Significant Disfigurement or Scarring; (4) Displaced Fracture; (5) Loss of Fetus; or (6) a Permanent Injury. A permanent injury is defined as an injury in which a body part or organ has not healed to function normally and will not heal to function normally with further medical treatment.
