Texter sued for distracting driver

A New Jersey woman is being sued for distracting a driver by carrying out a conversation through text messages.
Kyle Best was driving his pickup truck home from work while conversing with Shannon Colonna via text messages. While reading one of the messages, Best failed to pay adequate attention to the road and veered into the next lane, colliding with the motorcycle of David and Linda Kubert. The Kuberts, who both lost their left leg in the accident, are now suing Colonna for the role she played in their motorcycle accident.
The couple’s lawyer claims that the frequency of the texts between Best and Colonna was close to the speed of a verbal conversation, meaning she should be seen as “electronically present” at the accident, and therefore partially liable for it. Colonna’s lawyer says that a person who is sending text messages has the right to assume they will be responded to when it is safe.
Texting while driving is illegal in New Jersey, but it remains one of many common driving distractions that causes car accidents. If you have been hurt in an accident through no fault of your own, contact the New Jersey distracted driving lawyers of Levinson Axelrod, P.A., at 800-346-5529.
