Minors May Choose Workers’ Compensation Benefits or a Civil Suit

The New Jersey Workers’ Compensation Act prevents civil suits by an injured worker against a co-employee. This rule does not apply if the injured worker is a minor. A recent case in New Jersey allowed a minor employee to sue a co-employee who was driving a company vehicle involved in an accident. Here, the Court allowed the minor employee to sue not only the employer but also the supervisor who was driving the vehicle at the time of the accident.
