Qui Tam Actions

A qui tam action is a lawsuit brought by an individual due to some type of misconduct by some private entity. This case allows the individual, who is defined as an “informer”, to bring the case on behalf of all citizens against the entity. For example, if someone has discovered that some entity has been falsely billing medicare. This case allows the individual, informer, to bring this case against the entity. Typically the individual, informer has not been harmed any more than any other citizen. As a result of the information they provide, they can be awarded somewhere around 20% of the recovery that the government agency receives from the entity. Many of these cases are brought under the False Claims Act.
