Offer of Judgment

An Offer of Judgment is a Court Rule that allows a party to file a settlement document with the Court with a dollar figure that they are willing to settle the case for.

For example, if I am willing to accept $5,000.00 to settle my case, I can file this document with the Court. This document must be replied to by my adversary. If they do not accept my settlement (Offer of Judgment) and I go to Trial and get an award of $9,000.00, my adversary would have to pay my attorney’s fees. This rule was adopted to facilitate the settlement of cases and should be utilized in certain cases.
