Notice is Often Required

Many people believe that if they are injured on another person’s property that the owner is automatically responsible. This is just not true. Whether you are injured in a place of business or on a neighbors property or some other property, the injured party still must show thorough evidence that the owner was negligent. In order to prove that someone acted negligently, you first have to prove that they had knowledge of the condition that caused the injury.

For example, if a patron is injured in a supermarket due to a product being left on the floor, the patron must prove that either the owner or one of his or her agents know or should have known about the dangerous condition. It’s simply not enough to prove that you fell on a product that was left in an aisle.

Knowledge of the condition can be proven through evidence that establishes, for example, who is responsible for aisle inspections and how often they are done. Witnesses are crucial in any of these cases so it is important to get as much information as you can before you leave the premises where you were injured.
