Erb’s Palsy and Medical Malpractice

Erb’s palsy (also known as brachial palsy) is caused by damage to the brachial plexus, a bundle of nerves located at the top of the shoulder that extends down the arm. This damage can heal on its own over time or may be permanent, depending on the extent of damage done. It is most commonly caused by injuries suffered by an infant during gestation, childbirth, or the first few weeks of life.

If your child has been diagnosed with brachial palsy because of errors made by a delivery room doctor or other physician, you could have grounds for a medical malpractice claim. To discuss your rights with a knowledgeable New Jersey birth injury lawyer, contact Levinson Axelrod, P.A. at 800-346-5529.

Causes and Consequences of Brachial Palsy

An infant may suffer from this condition if:

  • An obstetrician misuses forceps or a vacuum during his or her birth
  • A doctor fails to notice and address birth complications in a timely manner
  • Excessive pressure is applied to the child’s arm, neck, or shoulder during birth
  • The symptoms of Erb’s palsy can vary depending on the specific nature of the injury. Common symptoms of this condition include:
  • Decreased functioning in the affected limb
  • Impaired development of the limb’s muscles (in prolonged cases)
  • Weakened grip in the affected hand

These symptoms may fade on their own over time, or the infant’s parents may need to undergo regular exercises with him or her to promote muscle growth. In more serious cases, children may even need surgery to repair the nerve damage. Unfortunately, some cases result in permanent disability even with extensive treatment.
