PORTEE CLAIMS

Portee claims are a relatively new type of case that allows certain relatives to file a case for damages when they have suffered damages as a result of witnessing a relatives’ injury.

For example, if a child witnesses the death of a parent in a car accident, that child could make a Portee claim against the negligent party.

There are very few instances where Portee claims can be brought. It is not an easy burden of proof for the Plaintiff.
