A new recent New Jersey case has concluded that in order for a Plaintiff to obtain money for emotional distress damages they need not have medical treatment nor medical testimony supporting their claim. What this case does is allow a Plaintiff to allege emotional distress damages by simply testifying in Court that the daily stress, such as headaches, stomach pains, nervousness, anxiety and depression was caused by the workplace. Even without medical documentation this case allows the court to award money damages for this claim.
