CHILD SUPPORT LIENS IN WORKERS’ COMPENSATION CASES
Pursuant to recent changes in the Law, permanent compensation benefits are now subject to child support liens. These liens are determined by the Judge of Compensation at the time of a hearing. If the award is greater than $2,000.00, then the child support lien must be paid back in full. Depending on the number of weeks in arrears, the deduction from Petitioner’s award may be structured. These liens are filed with the Division of Workers’ Compensation and are routinely discovered by Compensation Judges.
No one should be led to believe that by not revealing their child support lien that the lien will not have to be satisfied. Child support liens are almost always discovered before an injured worker received any permanent disability award.
