CHANGING ATTORNEYS
Many people find at some point during their case that they are no longer connecting with their attorney. In some cases, the lines of communication are so bad that the client no longer has any confidence in the attorneys’ ability to handle their case. If the situation has deteriorated to the point where the client no longer wants his or her current attorney, the best way to accomplish a smooth transition is to do the following:
1) Notify your present attorney that you are not satisfied with the way the case is being handled.
2) Advise your new attorney that you want them to handle your case.
3) Do not get involved in negotiating costs, fee splits, or any other monetary disputes between the attorneys.
4) Keep on top of your new attorney. Make sure he or she has requested your file and has followed up to get your file in case your former attorney has refused to voluntarily turn it over to your new attorney.
Many times, cases are left for months at a time without any forward progress because either attorney is not doing what needs to be done.
